All orders are accepted by HPI BVBA on these conditions of sale, unless otherwise agreed in writing by a Director of the company. All descriptions and illustrations, or any prices are intended merely to present the general idea of the Products and nothing contained in any of them shall form any part of the contract between HPI BVBA and the Customer. No liability can be accepted for errors or omissions in any technical data or literature supplied to the customer.

Pricing
All international orders are subject to shipping restrictions and surcharges where applicable. All prices listed are in Euro, they do not include VAT (where applicable) or shipping costs.

Quotations
Quotations are valid for thirty days. They may be withdrawn at any time before issue of an “Order Acknowledgement” or despatch of the goods whichever occurs first. HPI BVBA reserves the right to refuse an order once accepted. All quotations are subject to VAT at the applicable rate.

Payment
For account customers’ payment shall be made in full no later than thirty days from the date of invoice. Deliveries will be suspended where payment is not received in accordance with the above. Most credit and debit cards are accepted only as payment when ordering. Credit card payments may be subject to the authorisation procedure and will be refused by HPI BVBA should the issuing card authority not authorise payment.

Ordering
Orders will be accepted by telephone, fax, e-mail and on-line. Unless the customer has an account with HPI BVBA payment must be made by credit or debit card. For orders sent by fax or e-mail please ensure you include the following information: your name, mailing address, shipping address (if different), phone number and payment method. If paying by credit/debit card please include the card number, signature, expiry date and if using a switch card the issue number. HPI BVBA may in certain circumstances, decline to trade with any company or individual. Also and not withstanding any other provisions of these conditions of sale, HPI BVBA may decline to accept any order, whether or not payment has been received, by giving the customer written notice of non-acceptance within one working day of receipt of an order. Should a customer’s order not be accepted in respect of which payment has been received, the full amount of any such payment will be refunded.

Exports
The customer acknowledges that any products or technical data may be subject to the export control restrictions applicable to HPI BVBA and/or the customer under Belgian or foreign laws or regulations. The customer will not do or omit to do anything that would place HPI BVBA in breach of the said laws and regulations.

Delivery
Normally, orders received are despatched within 24 hours. HPI BVBA accepts no responsibility for failure to deliver within the estimated delivery times. HPI BVBA reserves the right to deliver in more than one shipment. A charge will be made against orders to cover the cost of carriage and packing. Special deliveries will incur extra costs.

Shortages or damage in transit
The customer must inspect delivered products as soon as is reasonably possible following delivery. Any damage or shortage must be reported to HPI BVBA within seven working days. If the customer fails to give such notice, the product shall be conclusively presumed to be in all respects in accordance with the contract, and free from any fault or defect which would be apparent on reasonable examination. The customer shall be deemed to have accepted the products accordingly.

Warranty & Returns
Road bike, enduro, quad and jetski components are guaranteed for six months and for cross bikes three months from the date of despatch. HPI BVBA guarantees, at its discretion, to replace any goods found to our satisfaction to be defective within six (non-cross) / three (cross) months from the date of despatch, provided that the goods have not been subjected to conditions beyond their specification, and have not been altered (cut wires etc.) All of our products must be installed by either us, or one of our dealers. HPI BVBA will undertake to test any defective goods. If these goods are found to be in good working order HPI BVBA reserves the right to make an administration charge to the customer. HPI BVBA will not accept returned goods without prior consent, except under guarantee. A handling charge may be made on returned goods. All returns must be accompanied by a copy of the original invoice. If HPI BVBA agrees to accept returned goods other than under guarantee the goods shall be in original condition. Any delivery charges incurred will not be refunded. Faulty goods must be returned carriage paid and with full details of failure.

Cancellation
Cancellation of orders can only be accepted after prior agreement. All cancellations will be subject to a cancellation charge.

Liability
HPI BVBA accept no liability in relation to consequential damage, injury, death or loss of revenue arising from defective items.

Privacy protection
To comply whit the GDPR privacy rules, HPI informs you which personal data we retain in our database. Our order processing system uses your name, address, e-mail address and phone number. HPI uses this data only to send you the information you requested. (orders, confirmations, invoices, quotations) HPI will never distribute personal data to third parties. If you want your data to be removed from our database, please contact us in writing.
